General Terms and Conditions

§ 1 Scope

(1) These General Terms and Conditions apply to contracts for the rental of hotel rooms for accommodation purposes as well as all further services and supplies provided to the guest by the hotel (accommodation contract).

(2) The subletting or further letting of the rooms provided, as well as their use for purposes other than accommodation, require the prior written consent of the hotel.

(3) The guest's general terms and conditions apply only if this has been expressly agreed in writing in advance.

§ 2 Conclusion of Contract, Contracting Parties, Liability

(1) The contract is concluded upon the hotel's acceptance of the guest's booking request. Acceptance requires confirmation in text form (e-mail) or orally. The hotel is free to confirm the booking in writing (e-mail).

(2) The contracting parties are the hotel (Landhaus Schend, owner Eugen Beimler) and the guest. If a third party has placed the order on behalf of the guest, that party is liable to the hotel together with the guest as joint and several debtors for all obligations arising from the accommodation contract.

(3) The hotel is liable for its obligations under the contract in all cases in which intent or gross negligence on the part of the hotel, its legal representatives or vicarious agents is involved, as well as in the event of a breach of material contractual obligations (cardinal obligations). In all other respects, the hotel's liability — regardless of the legal grounds — is limited to the damage typical for the contract and foreseeable.

(4) For items brought in, the hotel is liable in accordance with the statutory provisions, i.e. up to one hundred times the room price, but no more than 3.500 EUR, and for money, securities and valuables up to 800 EUR. Money, securities and valuables can be deposited in the hotel safe / at reception up to a maximum value of 8.000 EUR.

§ 3 Services, Prices, Payment

(1) The hotel is obliged to keep the rooms booked by the guest available and to provide the agreed services.

(2) The guest is obliged to pay the hotel's applicable or agreed prices for the provision of the room and for any further services used. This also applies to services and outlays of the hotel to third parties caused by the guest.

(3) The agreed prices include the respective statutory value added tax. Any municipal bed tax / visitor's tax is shown separately and — if levied — is to be paid additionally by the guest.

(4) Payment is made on site upon arrival or departure (cash, EC or credit card). No online payments, deposits or credit card details are collected via the website. For group or special bookings, the hotel may agree on a reasonable written reservation confirmation or deposit prior to arrival; the guest will be informed of this separately in advance.

(5) The hotel's invoices are due for payment immediately upon receipt without deduction. In the event of default in payment, the hotel is entitled to demand default interest at the statutory rate.

§ 4 Withdrawal by the Guest (Cancellation)

(1) The guest may cancel the booking free of charge at any time. No cancellation fees are incurred — regardless of how shortly before arrival the cancellation is made.

(2) Cancellation is made informally by telephone (+49 6573 306) or by e-mail ([email protected]). No justification is required; the hotel will confirm receipt of the cancellation to you.

(3) The hotel kindly asks that a booking that is no longer needed be cancelled as early as possible so that the room is available to other guests. Even in the event of a short-notice cancellation or non-arrival (no-show), the guest incurs no costs.

§ 5 Withdrawal by the Hotel

(1) The hotel is entitled to withdraw from the contract if the agreed advance payment or security deposit is not provided despite a reminder with a reasonable grace period.

(2) In the event of force majeure or other unforeseeable circumstances for which the hotel is not responsible and which make the performance of the contract impossible, the hotel is entitled to withdraw free of charge.

(3) The hotel may also withdraw from the contract extraordinarily for an objectively justified reason, in particular in the event of a justified suspicion that the use of the hotel service could jeopardise the smooth running of the business, the safety or the reputation of the hotel.

§ 6 Provision, Handover and Return of Rooms

(1) The guest has no claim to the provision of specific rooms.

(2) Booked rooms are available to the guest from 15:00 on the agreed day of arrival. The guest has no claim to earlier provision.

(3) On the agreed day of departure, the rooms are to be vacated and made available to the hotel by 11:00. Thereafter, for the use of the room beyond the time resulting from late vacating, the hotel may charge 50 % of the full lodging price until 18:00, and 100 % from 18:00. No contractual claims of the guest arise as a result.

§ 7 Pets

Pets (in particular dogs) may be brought along after prior arrangement with the hotel. A cleaning / hygiene surcharge of currently 15 € per day is charged.

§ 8 House Rules

The following rules apply in the hotel in particular: quiet hours from 22:00; smoking is prohibited in all indoor areas. Detailed house rules with further information (e. g. on breakfast and check-out times) are available in the hotel and can be viewed at reception. Changes to the house rules apply only insofar as they are reasonable for the guest and compatible with their legitimate interests.

§ 9 Final Provisions

(1) Amendments or additions to the contract, the acceptance of the application or these terms and conditions should be made in text form.

(2) The place of performance and payment is the registered office of the hotel.

(3) German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions remain unaffected.

(4) Should individual provisions of these General Terms and Conditions be or become invalid or void, the validity of the remaining provisions shall not be affected thereby. In all other respects, the statutory provisions apply.
